EMPLOYMENT RELEASE

FOR GOOD AND VALUABLE CONSIDERATION, including the terms set out in the letter from BBVS Inc. operating as Singer’s Edge & Toronto Arts Academy to me, , outlining the terms of any bonuses or severance packages (the receipt of which I acknowledge); I, , on behalf of myself and my heirs, executors and assigns:

release and discharge BBVS Inc. operating as Singer’s Edge & Toronto Arts Academy, and all of its affiliated, related, subsidiary, predecessor, successor and parent organizations, and each of their respective officers, directors, employees and agents and their heirs, executors, administrators and assigns (hereinafter collectively referred to as “Singer’s Edge”) from all actions, causes of action, debts, covenants, contracts, agreements, claims and potential claims that I have against Singer’s Edge for any reason at all, including but not limited to claims for wages, overtime pay, vacation pay, commissions, bonuses, profit-sharing, expenses, benefits, termination pay, severance pay, reasonable notice or pay in lieu of such notice, any statutory right to reinstatement or any other matter arising out of my employment with Singer’s Edge or the cessation thereof;
acknowledge that the within payments include any amounts to which I may be entitled under the Employment Standards Act 2000;
acknowledge that the parties to this release have discussed or otherwise canvassed any and all human rights complaints, concerns, or issues, arising out of or in respect of my employment with Singer’s Edge, if applicable;
agree that this agreement constitutes a full and final settlement of any existing, planned or possible complaint or complaints against Singer’s Edge & Toronto Arts Academy under the Human Rights Code up to the date of this agreement, arising out of or with respect to my employment with Singer’s Edge;
agree to release Singer’s Edge & Toronto Arts Academy from any and all liability related to my employment with Singer’s Edge or the termination thereof, including liability under the Ontario Employment Standards Act 2000 and any other applicable provincial or federal legislation;
acknowledge that Singer’s Edge & Toronto Arts Academy has satisfied its obligations under the Workplace Safety and Insurance Act;
agree to indemnify and save Singer’s Edge & Toronto Arts Academy harmless from all claims, actions and demands under the Income Tax Act (Canada), the Canada Pension Act or the Employment Insurance Act, including any regulations made thereunder, and any other statute or regulations for or in respect of any failure on the part of Singer’s Edge & Toronto Arts Academy to withhold income, tax, Canada Pension Plan premiums, employment insurance premiums or benefit overpayments or any other tax, premium, payment or levy in connection with or arising from the payments made to me pursuant to this agreement;
will not make any claim or take proceedings against any other person or entity that might claim contribution or indemnity from Singer’s Edge & Toronto Arts Academy in respect of any matter covered by this release;
agree to keep the terms of this settlement confidential and will not disclose the terms of this agreement except to my solicitor, financial advisor or immediate family members (provided that they also agree to keep the terms of this settlement confidential), or as required by law;
acknowledge that during the term of my employment I acquired information of a confidential nature that belongs to Singer’s Edge & Toronto Arts Academy including but not limited to, financial information and trade secrets, which I will not disclose in any manner except as required by law;
confirm that I have returned all property belonging to Singer’s Edge & Toronto Arts Academy in my possession and state that if I discover any property belonging to Singer’s Edge & Toronto Arts Academy in my possession in the future, I will promptly return it;
agree not to make any statements or engage in any acts that may cast a slur on or in any way disparage or adversely affect the reputation or goodwill of Singer’s Edge & Toronto Arts Academy;
understand that if I breach any term of this release, I may be liable for damages, including but not limited to a return of all or a portion of the settlement funds provided to me;
acknowledge that this settlement is not an admission of liability by Singer’s Edge & Toronto Arts Academy; and
agree that I have been given sufficient time and opportunity to obtain independent legal advice before signing this release, signed without duress, and have sought independent legal advice or have freely chosen not to do so.
