Re: Offer of Employment

We are pleased to offer you employment with BBVS Inc. operating as Singer’s Edge & Toronto Arts Academy (“The Academy") in the role of Front Desk Assistant ("The Employee"), on the basis of the terms contained within this letter. 

Start Date & Term

This agreement begins as of the date this agreement is signed, and shall continue indefinitely until terminated in accordance with the terms set out below.

Duties

In your role, you will provide office reception services plus administrative support in a team-spirited environment.  In addition to any duties specifically discussed with you during your interview, we have outlined below some of the standard tasks which we will expect you to perform, all associated with the day-to-day operation of our business:

  • Providing general outstanding customer service for academy students and prospective students via emails and phone calls for Academy bookings.
  • Provide assistance with other administrative tasks.
  • Act as the first point of contact for all phone and email inquiries
  • Reflect the consummate professionalism of the SE & TAA brand in all student interactions.
  • Providing general information and customer service while answering questions from potential clients about The Academy.
  • Direct potential clients or seek out on their behalf the appropriate SE & TAA representative for further information;
  • Follow up with new students, and unregistered students who’ve been to the Academy to provide customer service.
  • Manage requests, waiting lists, email lists, and track lesson schedule changes.
  • Create newsletters and other marketing materials from templates
  • Schedule and manage bookings for all teachers in the Academy;
  • Inputting/maintaining client information into scheduling and financial management systems.
  • Input daily summary reporting details

You will be expected to be aware of and comply with The Academy's workplace policies and handbook currently called "Happiest School Requirements" with both Safety Procedures as well Work & Engagement procedures, a copy of which is available on our staff page at TorontoArtsAcademy.com/staff. Hours of Work

The schedule may be ad-hoc as needed through the first weeks of training. Following training, we always aim to ensure that your days and hours be consistent as possible, and spread between locations, although they may be subject to change to accommodate business needs (staff holidays, swaps, etc). It is expected that your weekly days of work will be based on the following schedule:

Please provide The Academy with as much advance notice as possible of any change to your availability to the extent possible. Also note that we may not be able to accommodate all requests for permanent availability changes. 

Although we strive to maintain a 4 day/week schedule for staff, The Academy may occasionally be required to schedule staff for 5 days depending on business needs, such as requiring coverage for other front desk staff's vacations and personal days. 

Compensation, Vacation & Personal Days

You will be paid an hourly wage of $21.00 per hour.  You are entitled to take 30 minutes break time each day. We are pleased to provide these breaks as paid for your benefit.

Your rate of pay is expected to remain confidential.  This amount will be subject to applicable statutory deductions and is paid on a semi-monthly basis, on the 3rd and 18th of each month, by direct deposit.  Please submit a void cheque for direct deposit of your wages.

You will receive 4% of your gross wages on each pay on account of vacation pay.  You are also entitled optionally to two weeks unpaid vacation per year, after each entitlement year, to be taken with prior approval.  Vacation time must be pre-approved and will be scheduled at mutually convenient times. 

In total, you may take up to 10 days of job-protected Personal Days each calendar year. This is known in Ontario as personal emergency leave (PEL). We are pleased to offer the first 2 of your 10 personal days of each year as paid, and the remaining 8 days as unpaid.

Protection of Business Interests

Confidentiality

You may receive, during the course of your employment with The Academy, information which is confidential or which constitutes trade secrets, personal information, or other such confidential information, regarding The Academy's clients, or its curriculum, methods, operations, and business.  You hereby agree that you shall not use, permit the use, and/or divulge any confidential information of any kind obtained in the course of providing services to The Academy unless specifically authorized to do so by The Academy, in writing.  This obligation to keep such information confidential survives the termination of this Agreement.

The Employee agrees that the SE & TAA has a proprietary interest in its clients, pricing information, teaching materials, operational systems, marketing materials, and other methodologies.  The Employee agrees not to reveal or convert such proprietary information to the  Employee’s personal benefit, or for the benefit of any competing business.

The Employee agrees to decline to comment on any media inquiries regarding The Academy or the Director and will refer all such inquiries to the Director for follow up.

Non-Solicitation

For the duration of your employment, and for a period of one (1) year following the termination of your employment, for any reason, you will not, directly or indirectly, solicit or provide services competitive to the services provided by The Academy, to any client of The Academy.  You also agree that you will not, during your employment or for a period of one (1) year following the termination of your employment, for any reason, solicit The Academy's staff or contractors with a view to enticing or encouraging an individual to leave the employ of The Academy's or cease to continue to provide services to it. 

Use of Likeness

The academy takes many pictures and videos of the Academy and at various Academy events for social media, marketing purposes, and for the enjoyment of students, of which you may be included. You hereby grant The Academy the right to use your name, likeness, and/or voice in connection with instructional materials and marketing materials, and to exhibit or distribute the materials, in whole or in part, in any and all media, whether now known or hereafter devised, throughout the world, without restrictions or limitations, for any purpose which The Academy and those acting pursuant to its authority deem appropriate. You agree that you shall have no claim against SE & TAA or against anyone accessing such materials, and that he or she has not given anyone the exclusive right to use his or her name, likeness, and/or voice. 

Probation & Termination

While we recognize that it is never pleasant to discuss the possibility of ending the relationship at its commencement, we feel that each of us benefits if we set out our expectations at the beginning. For this reason, we provide the following:

  1. we may terminate your employment, at any time and without notice or payment in lieu thereof, in respect of any omission or commission which constitutes just cause for termination. If you are terminated for cause, you will not be entitled to notice, or pay in lieu of notice, except for your minimum entitlements, if any, under the Employment Standards Act, 2000 (“ESA”);
  2. the first three (3) months of your employment will be probationary.  Accordingly, your employment may be terminated at any time during the probationary period, without cause and without notice;
  3. after the first three (3) months of your employment, your employment may be terminated at any time, without cause, upon the The Academy providing you with the minimum notice required by the ESA, or pay in lieu of that minimum notice period.  If at the time of termination you are entitled to participate in any employer-sponsored benefits, those benefits will also continue for the minimum period required by the ESA; and,
  4. if you resign from your employment, you agree to provide The Academy with at least two (2) weeks’ prior written working notice. 

In accepting this offer of employment, you acknowledge that the above will be your only entitlement to notice or pay in lieu upon termination, and includes any entitlements you may have, both statutory and at common law.
